Tuning, Dyno & Performance Work Agreement
A clear record of the work authorised, its intended use and the customer's responsibilities.
Version tuning-agreement-2026-10-v3
1. Scope and intended use
- 1.1 This agreement covers rolling-road/dyno testing, ECU or TCU software, remapping, coding and performance parts supplied or carried out by PPL TUNING LTD (“PPL”). References to PPL include its directors, employees, technicians and agents.
- 1.2 Unless PPL records a public-road requirement in this agreement, tuning, dyno and competition-performance work is provided on the basis that the vehicle is intended for a closed track, competition, private land or other use away from the public highway with the landowner's permission.
- 1.3 Some parts, calibrations or functions may not be approved for public-road use and may affect emissions, noise, safety systems, insurance, manufacturer warranty or MOT status. A track/off-road item is not represented by PPL as road legal or MOT compliant.
- 1.4 If continued public-road legality or MOT compatibility is required, the customer must tell PPL before work starts and that requirement must be recorded in the digital work record.
2. Vehicle condition and work on the vehicle
- 2.1 The customer must disclose known faults, warning lights, leaks, unusual noises, recent repairs and existing modifications. The customer must present the vehicle with suitable oil, coolant, fuel, tyres and general mechanical condition for the authorised work.
- 2.2 Tuning, coding, diagnosis and fitting involve connecting to, reprogramming and working on the vehicle's control units and systems. While this work is carried out, some systems and features may be affected, reset or temporarily disabled — for example stored settings and adaptations, warning lights and fault codes, comfort, infotainment and driver-assistance functions, key and immobiliser pairing, and battery charge. These are recognised and reasonably expected effects of performance work, and PPL will take reasonable care to restore normal operation where it is practical to do so.
- 2.3 Writing software to a control unit carries an inherent risk that the unit will not accept or complete the update, for reasons outside PPL's control such as an existing fault in the unit, its wiring or the vehicle's battery. PPL follows the appropriate procedure for the vehicle and takes reasonable precautions, including supporting battery voltage during the work.
- 2.4 Working on a vehicle can reveal or bring forward a fault that already existed or was developing, including in components that are not being worked on. PPL may stop or refuse work where the vehicle appears unsuitable or unsafe.
- 2.5 Subject to section 8, PPL is not responsible for the effects described in clauses 2.2 to 2.4, or for failure caused by a pre-existing or latent defect, inadequate maintenance, inaccurate customer information or unsuitable customer-supplied parts, except where caused by PPL's failure to use reasonable care and skill.
3. Dyno testing
- 3.1 Dyno (rolling-road) testing runs the vehicle at full load and high engine speed for sustained periods, usually as a series of runs. This deliberately places the engine, gearbox, clutch, driveshafts, differential, cooling, fuel and exhaust systems and tyres under far greater stress than normal road use.
- 3.2 Because of this, a component that is worn, weak, incorrectly fitted or close to failure may fail during or because of a dyno session, even where PPL uses reasonable care and skill. Examples include turbochargers, clutches, gearboxes, driveshafts, hoses, belts and chains, gaskets and tyres.
- 3.3 Before the session the customer must tell PPL about any known faults, warning lights, leaks, unusual noises, recent repairs and modifications, and confirm the vehicle has been maintained and is fit for full-load testing. PPL may carry out pre-run checks and may decline, stop or limit a session at any point if it reasonably considers the vehicle unsuitable or unsafe. Time used up to that point remains chargeable.
- 3.4 The vehicle is secured to the dyno and run by PPL staff. The customer and anyone with them must follow PPL's instructions and stay out of the dyno area during runs unless PPL permits otherwise.
- 3.5 Power and torque figures depend on the vehicle, fuel, tyres, temperature, air pressure, correction method and the dyno itself. They are estimates for the test conditions, may differ from results produced elsewhere, and no particular figure is guaranteed.
- 3.6 Subject to section 8, PPL is not responsible for failure of, or damage to, the vehicle resulting from the ordinary stresses of the authorised dyno session acting on a component that was worn, defective or unsuitable, or from information the customer did not disclose, except where caused by PPL's failure to use reasonable care and skill.
4. Parts, performance and aftercare
- 4.1 PPL does not warrant the quality, provenance, condition, specification or compatibility of customer-supplied parts. The customer is responsible for additional diagnosis, removal or replacement arising from an unsuitable customer-supplied part unless the issue was caused by PPL's failure to use reasonable care and skill when fitting it.
- 4.2 PPL-supplied parts remain subject to the customer's statutory rights and any applicable manufacturer warranty. Unauthorised alteration, misuse or third-party repair may affect a voluntary warranty where connected to the fault.
- 4.3 Increased power, torque, boost, temperature or load can accelerate wear and reveal weak components. The customer accepts those inherent modification risks where they are not caused by PPL's breach of contract or negligence.
- 4.4 Unless PPL records otherwise, petrol vehicles must use 99 RON fuel. The customer must warm the vehicle fully before high-load use, allow suitable cooling afterwards, monitor fluids and warnings, stop if a fault appears and maintain the vehicle more frequently where its modified or track use reasonably requires it.
5. MOT status and responsibility for road use
- 5.1 This is a tuning, dyno and performance-work agreement only. It is not an MOT loss/damage disclaimer, must not be used as a condition of an MOT test, and does not certify roadworthiness, road legality or MOT compliance. A formal MOT exists only where separately arranged, registered on the DVSA MOT testing service and completed with the appropriate official MOT record.
- 5.2 A technician's separate status as an authorised MOT tester does not turn tuning, dyno, parts or repair work into MOT approval. When providing those services, the person acts as a PPL technician unless a formal MOT test is being conducted. Nothing in this agreement changes any DVSA requirement or statutory duty.
- 5.3 After collection, the customer is responsible for how and where the vehicle is used, keeping it roadworthy, arranging any required inspection, notifying the DVLA where necessary, declaring modifications to the insurer and maintaining valid insurance.
- 5.4 PPL does not authorise unlawful public-road use. Subject to section 8, PPL is not responsible for fines, prosecution, seizure, MOT failure, insurance consequences or other loss arising where the customer, keeper, driver or anyone acting for them uses a track/off-road specification on a public road without lawful authority.
6. Vehicle collection
- 6.1 PPL will record either Standard Collection or Transport Collection Required after completing the work. Standard Collection does not amount to an MOT certificate or an ongoing guarantee of roadworthiness.
- 6.2 Transport Collection Required will apply where the completed specification is intended only for track/private-land use or is unsuitable for lawful public-road use. The customer must arrange a suitable trailer or professional recovery vehicle. PPL may decline to release the vehicle for road driving, and it must not be used on a public road until returned to a legally compliant condition.
- 6.3 The customer must provide accurate collection and transport information and ensure that anyone collecting for them follows PPL's recorded instruction. If false or misleading details are provided, suitable transport is not used, the vehicle is unloaded for road use, or it is otherwise used contrary to that instruction after leaving PPL's custody, that conduct is not authorised by PPL and is the responsibility of the customer and the person concerned. The collection status PPL records is the instruction given to the customer at collection, and the customer's acceptance of this agreement covers it.
7. Revisions, charges and remedies
- 7.1 One reasonable software revision requested within seven calendar days after collection is included where PPL agrees the reported behaviour is connected to its calibration. New performance requests, new parts, third-party changes, unrelated diagnosis and later sessions are chargeable.
- 7.2 The agreed price and deposit are recorded in the digital work record. Diagnostic time and completed work remain chargeable where a requested target cannot safely be achieved, provided PPL performed the agreed service with reasonable care and skill.
- 7.3 Nothing in this agreement removes a legal remedy available where goods are faulty or services were not performed with reasonable care and skill. PPL should first be given a reasonable opportunity to inspect and, where legally appropriate, remedy the relevant work.
8. Liability and legal rights
- 8.1 Nothing excludes or restricts liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.
- 8.2 Subject to clause 8.1, PPL is not responsible for loss caused by unlawful or unauthorised road use, false or misleading collection information, failure to use required transport, undisclosed faults or modifications, pre-existing or latent defects, the reasonably expected effects of work on the vehicle's systems described in section 2, the ordinary stresses of an authorised dyno session on a worn or unsuitable component as described in section 3, customer-supplied or third-party parts/software, third-party alteration, inadequate maintenance or use outside the agreed specification.
- 8.3 For business customers, and subject to clause 8.1, PPL is not liable for indirect or consequential loss or loss of profit, revenue, business, opportunity or anticipated savings. Any limitation applies only where permitted by law and fair and reasonable.
- 8.4 PPL's directors, employees, technicians and agents may rely on the protections in this agreement under the Contracts (Rights of Third Parties) Act 1999. English law governs this agreement, subject to mandatory consumer rights.
9. Cancellation, deposits and starting work
- 9.1 Where this agreement is concluded away from PPL's premises — for example where the customer completes and accepts it remotely — the customer has the right to cancel within 14 days of entering into it, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, the customer should tell PPL by any clear statement, including by email to info@ppl-tuning.com. Where the agreement is concluded in person at PPL's premises, that statutory cancellation right does not arise.
- 9.2 Work will often need to begin before the 14-day period ends. By accepting this agreement and expressly requesting that PPL begins, the customer asks PPL to start within the cancellation period and acknowledges that if they then cancel they must pay for what has already been supplied, in proportion to the work performed up to the point PPL is told.
- 9.3 Software calibration is written or adapted for the customer's individual vehicle. Once that work has been carried out the customer may lose the right to cancel in respect of it, as goods and services made to the customer's specification or clearly personalised are excluded from the statutory cancellation right.
- 9.4 A deposit secures the booking and covers costs PPL commits to in advance, including special-order parts. Where the customer cancels, PPL will retain only what is reasonably required to cover costs already incurred and work already performed, and will refund the balance. Special-order parts already obtained for the customer remain chargeable.
- 9.5 If PPL cancels or cannot safely carry out the agreed work, the customer will be refunded in full except for work already properly performed and agreed at the customer's request.
10. Your information
- 10.1 PPL TUNING LTD is the controller of the personal information provided in this agreement. It is used to carry out and record the authorised work, to contact the customer about the vehicle, and to keep evidence of what was authorised and accepted.
- 10.2 This signed agreement, including the details entered, the acceptance record and the date and time, is retained indefinitely. PPL relies on its legitimate interests in maintaining a durable record of work authorised on a vehicle and in establishing, exercising or defending legal claims.
- 10.3 The customer may ask PPL what information it holds about them, ask for inaccurate information to be corrected, or object to its use, by contacting info@ppl-tuning.com. Because this is a signed legal record, PPL may be unable to delete it while it may still be needed for the purposes in clause 10.2. A complaint may be made to the Information Commissioner's Office at ico.org.uk.
- 10.4 PPL's full privacy policy is published at ppl-tuning.com/legal/privacy-policy.
